Lathrop GPM Partner Michael Manoukian spoke with Law360 about a COVID-19 vaccine litigation cases to watch in 2025.
The Ninth Circuit is deciding whether to revive a religious discrimination case from an actor who said she was unlawfully kicked off a television show she starred in for refusing to get vaccinated against COVID-19.
Though the Ninth Circuit’s decision will be instructive, it may not be a panacea for employers’ questions about vaccines and employees’ religious rights, said employer-side Lathrop GPM LLP partner Michael Manoukian.
“I think the challenge here is that it’s going to be very hard for the Ninth Circuit to come out with an order that is going to be crystal clear and black-letter law that applies to every single employer within the Ninth Circuit,” Manoukian said. “And so I think even though there’s going to be some guidance once this decision comes out and once it’s published, I still think that there’s going to be ambiguity there.”
